How We Handle Construction Injury Claims?
Typically, a construction injury claim will have many parties involved including contractors, subcontractors and others. The first thing we will establish is who is at fault or who caused the condition which caused the accident. If possible, we will visit the construction site.
Of course, it has to be a very recent accident for us to do so. We always look at the following additional parties: property owner, general, subcontractors, etc.
We obtain the OSHA report (Occupational Safety And Health Administration
Report) which may list ongoing safety hazards, violations or potential fines, negative recommendations, etc., against the contractor. If we can get on site we will have an investigator take pictures.
We get copies of all permits pulled for the job. We obtain permits from the city or county office in charge of permit approval and inspections.
We are very familiar with 29 C.F.R. 1910 (general workplace regulations) and 29 C.F.R. 1926 (localized issues solely regarding construction).
These laws mandate certain safety oriented procedures and standards. We are always looking to show what could have been done to prevent the accident.
If we take the case we will hire the highest qualified industry expert and hire then for their analysis and expertise from the very beginning.
In this area of the law - construction injury cases - experts are of paramount importance. You cannot win without an expert. We may also bring in an OSHA expert as well.
Documents we obtain during the lawsuit process include all contracts between all parties to the project that are relevant, all safety manuals concerning corporate safety or project safety for each contractor or subcontractor, the safety plans for the specific site concerning job hazards, etc., toolbox talks which are regular meetings held on site during the project, progress reports and any previous OSHA warnings and citations.
Our usual construction case is a worker who trips or slips, falling object, collapse of a scaffold, debris trip and fall, and similar type accidents.
As soon as we sign the case up our investigators will move for statements and photographs at the accident site. We will get all the contracts, safety plans, meeting minutes, progress reports, photos, state and federal reports, diaries, initial onsite injury statements, medical records, paramedic reports, additional investigations such as building departments, police, fire, etc. If our client gives a statement for his worker's comp claim we will get it.
We will build every construction site accident case in a methodical and disciplined manner. We have experts who will determine the safety procedures and we have experts who will cross-examine defendants on whether or not they have safety procedures and whether or not they complied with them on the job site. We follow through with our plan by obtaining all documentation, getting the defendants to admit their responsibilities under the safety plan and their failure to comply with their own safety plans.
We will build the case to succeed because we know the defenses that the contractors will use.
