Fleet Phospho - Soda Side Effect Victims

The National Law Firm of Nadrich & Cohen and its national team experienced drug recall lawyers are reviewing potential claims on behalf of individuals who used Fleet Phospho – Soda the over the counter laxative for cleansing bowels as part of a colonoscopy preparation or other procedures. It has been determined that this product has been linked to a serious form of kidney damage known as acute phosphatenephropathy.  

What happened is that in December 2008 the Federal Drug Administration disseminated an Advisory Warning for individuals using oral sodium phosphate products such as the Fleet Phospho Soda for bowel cleansing.  The FDA has required the following:

1.    Visicol and Osmoprep now had to add a new Black Box Warning (a severe warning on the package label) about the risk of kidney damage from the use of the products.

2.    The FDA further stated in their December warning that over the counter laxatives such as the Fleet Phospho Soda products shouldn’t be used for bowel prep and should only be provided with a prescription.  Immediately thereafter, the manufacturer of Fleet Phospho Soda issued a recall of all Fleet Phospho Soda products.

Our position is that Fleet had been aware of the kidney damage risks for many years but still marketed the product as an effective bowel cleanser without adequate warnings to its users or to medical providers.  Unfortunately, consumers have been using the product without knowing that they could develop serious injuries such as acute phosphate neuropathy or other kidney damage.
