Talcum Powder Lawsuit Update

In the past, many women used talcum powder as part of their feminine hygiene. Many used Johnson & Johnson talcum powder products on their vaginal area to feel “fresh.” This daily regimen proved to cause more harm than good for many women. Research has linked talcum powder to ovarian cancer. In 1971, scientists found talc particles in tumor in the ovaries and cervix. In 2006, the use of talc in the genital area was declared carcinogenic to humans.

A recent court case put Johnson & Johnson on the hook for a whopping $4.69 billion in damages. A jury found that the talcum powder contained asbestos, which caused cancer for 22 women. The verdict, which includes $500 million in compensatory damages and more than $4 billion in punitive damages, was split among the women. Six have since died. This is more than the $417 million verdict that a California woman received from Johnson & Johnson last year.

The verdict was handed down on July 12 after eight hours of deliberation among the jury members. The jury spent weeks listening to testimony, which included experts discussing the scientific aspects of talcum powder. They also heard from Johnson & Johnson employees who claimed that their products were safe. They also heard the stories of the 22 victims, including the ones who had already died from cancer.

The amount of money involved in this case was extraordinarily high, but this won’t be the last case you see involving Johnson & Johnson and talcum powder. Thousands of other cases are making their way through the court system. In five of the cases that have gone to court so far, the women had a favorable outcome. Johnson & Johnson is in the process of appealing.

Last November, the court ruled in favor of Johnson & Johnson. A month earlier, a judge reversed two decisions. A $55 million verdict from June 2017 was thrown out.

For many years, Johnson & Johnson hid scientific studies and data showing that talcum powder contained asbestos, which led to cancer in many women. The company deliberately put millions of women at risk.

The hope was that the verdicts would force Johnson & Johnson to pull their talcum powder products from the market, or at the very least out a warning label on them. Despite the court rulings, however, the company denies that its products are harmful.
