Benzene Lawsuits Continue to Mount Against Chevron

Chevron denies liability in pending benzene lawsuits

Chevron USA is facing multiple lawsuits alleging serious injuries caused by benzene exposure.

The most recent benzene lawsuit was filed November 26, 2011 in Jefferson County, Texas. The suit, filed by Billie Ratcliff, alleges that her husband William was exposed to benzene throughout his employment with the company. As a result of, he developed a type of blood cancer known as multiple myeloma, which ultimately contributed to his death on April 12, 2011. Ms. Ratcliff also alleges that Chevron knew of the dangers of benzene for decades but failed to warn employees that the chemical could cause potentially fatal blood disorders and other serious conditions. Chevron has not publicly commented on the lawsuit.

A similar lawsuit was also filed in Jefferson County on August 31, 2011 by the family of Fred Gebauer. In the suit, Mr. Gebauer’s children, Keith Gebauer, Ronnie Gebauer, Lajunda Williams and Gaytha Guillot, claim that their father died from non-Hodgkins lymphoma, which he developed after being exposed to benzene during his employment at Chevron. The plaintiffs claim that Chevron acted negligently in allowing employees to be exposed to dangerous chemicals, which were known to be potentially hazardous. The complaint also alleges that Chevron failed to adequately warn employees about the dangers of benzene exposure.

On October 24, Chevron filed an answer to the lawsuit which stated that they were not a culpable party. Specifically, Chevron alleges that Fred Gebauer was actually employed by Texaco, which should be considered a separate entity, despite the fact that the two companies merged in 2001.
