Our Response to the Coronavirus and COVID19

The first and most important message to our clients – we are still here for you. Thanks to the high-tech, ahead-of-the-curve approach our firm has taken over the years, our attorneys and staff are equipped to work from home. Likewise, we have been conducting intake and other client interactions via telephone and teleconference. We are prepared to protect our clients’ legal interests with the same zeal and dedication that we have always used. We also offer telemedicine for our clients who do not want to meet their doctors face to face.
What does this mean for our valued clients at Nadrich & Cohen? Our legal specialists are still available for virtual case evaluations 24 hours a day, and our team is fully capable of handling all aspects of your case via phone and email, subject to the limitations of outside agencies such as Courts, insurance companies, and defense law firms, many of which are either closed or significantly curtailed. For everyone’s safety, we are not offering in-person consultations at this time.

Though our office is discouraging in-person meetings, each of our employees has access to your file and to each other. So, we are available to work on your case remotely, again – subject to the limitations of outside agencies and forces.
Most of the Civil Courts in the State are closed for hearings and trials. When they re-open, we will keep you updated.
We have been notified by several other firms and insurance companies that, because their offices are closed, they are not currently able to communicate on some matters. Please be patient with us as we work with those impacted firms and insurance carriers.
Many in-person meetings, mediations, depositions, hearings, and trial settings are currently canceled and will need to be rescheduled for a later date. We will let you know in advance if any in-person appearance involving you is canceled and requires rescheduling.

Nursing Homes/Long Term Care Facilities/Senior Citizen Homes/Cruise Ships
Any operating business such as a Nursing Home or Cruise Ship has the responsibility to make certain that it’s employees do not infect patients and passengers. It is imperative that there is a system in place where workers are trained not to expose patients or passengers with virus symptoms. There are also specific Nursing Home rules called Infection Reports protocols which the federal government requires. Often times, when an infection infraction occurs the nursing home does not so state in the required infection report logs what measures are being taken to prevent future infections or subsequent exposures. This is reckless and sadly and has caused COVID-19 to be transmitted to countless patients.
BUSINESS INTERRUPTION INSURANCE – Denial of Insurance, Business Interruption
We are investigating Business Interruption Claims of businesses that have insurance – General Comprehensive Liability. Businesses must be taken care of: after all, they pay monthly premiums in order to obtain assistance during times of need. Insurance companies are rejecting claims filed by restaurants, bars and similar type businesses who are seeking business interruption coverage. We believe they will reject all claims until the courts determine whether or not business interruption insurance applies for the COVID-19 pandemic. We expect to be in the vanguard for plaintiffs throughout California fighting insurance companies on these issues.
Many insurance companies have a virus exclusion which states they will not pay for loss or damage caused by or resulting from any virus, bacterium or other micro organism that induces or is capable of inducing physical illness or disease. Unfortunately, for the insurance companies, that is not the reason why restaurants are shut down – they were shut down by government action. The insurance companies should not be able to avoid paying business interruption policies. We believe that this is the trigger event of these policies and therefore coverage is the loss of use of the business which was shut down by the government.
