Why Are Zostavax Lawsuits Being Filed?

A multi-district litigation was recently formed combining over 50 Zostavax lawsuits against Merck and Bayer. These lawsuits allege the following:

  • Zostavax is unreasonably dangerous as designed;
  • Zostavax can lead to serious side effects or even death;
  • Merck failed to warn patients of Zostavax’s side effects;
  • Employees of Merck intentionally and knowingly misrepresented Zostavax’s safety.

Zostavax lawsuits have been filed for serious injuries including hearing loss, vision loss and death. The vaccine is even known to cause shingles – the condition it is designed to prevent. Acute retinal necrosis, seizures, limb paralysis, brain damage and fatal liver failure have also been reported. One lawsuit alleges a man who was given Zostavax lost the ability to walk shortly after receiving it. That man was diagnosed with acute transverse myelitis, an uncurable inflammation of the spinal cord.

What Are Our Zostavax Lawsuits Based On?

Our Zostavax lawsuits include that the vaccine, as designed, is unreasonably dangerous. The design of the product is harmful to consumers.

Merck and Bayer can be held liable in a design defect lawsuit when:

  • The plaintiff proves the product creates a dangerous risk to users of the product, and
  • The dangerous risk happened while the product was being used for its intended purpose.

We also believe the manufacturers knew or should have known of the serious risks associated with Zostavax’s design.

Center For Disease Control (CDC) Recommends Shingrix Over Zostavax

cdc zostavax

In 2017, a CDC advisory panel recommended the use of Shingrix over the use of Zostavax.  Zostavax has shown a 51% reduction in shingles. However, clinical trials have shown Shingrix to be around 98% effective in its first year and 85% effective over a three year period.

Studies have shown that Shingrix is 91% effective against post-herpetic neuralgia, compared to Zostavax’s 67% effectiveness against the same condition.

Zostavax uses a live, weakened form of the herpes zoster virus. Shingrix, however, uses a non-live piece of the virus, reducing the chances of an adverse reaction.

How Do Zostavax Patients Develop Shingles?

It seems counter-intuitive that a shingles vaccine would cause patients to develop shingles.

Zostavax utilizes a live, weakened form of the virus responsible for shingles. Patients who are immunocompromised find that their immune system is too weak to fight off the weakened form of the virus. This can cause the patients to develop shingles.
