The metal-on-metal hip implant system was the target of a recall in August 2010 after research indicated that the mechanism had a 12-13 percent catastrophic failure rate in the first five years. Other studies have suggested the failure rate may actually be much higher, ranging from 25% to 50% in the first six years.

No settlements have yet been offered in any of these cases, although it is speculated that both DePuy and Johnson & Johnson may wait to offer settlements until after the statute of limitations for filing a lawsuit has passed. Each state has a different time limit for filing this type of litigation, typically spanning from one to three years.
