Defective tires are responsible for almost 8,000 car accidents in the United States every year. Many defective tires don’t show up until they are under stress, usually at a high speed, resulting very often in a fatal car accident.

Several high profile tire recalls have occurred in the past, many were brought about following a catastrophic car accident caused by defective tires.

Our law firm has represented thousands of car accident victims. California is home to some of the most dangerous highways in America, for example, there is a high number of car accidents on Highway 99 each year. In fact, Highway 99 has one of the highest auto traffic fatality rates in the country.

Defective Tires Discovered After Car Accidents

Most defective tires are discovered after tread separation or a blowout occurs. Tire blowouts can be frightening because they occur so suddenly, but you can help prevent a deadly car accident by staying calm if your tire blows or separates while you’re driving.

Since the passage of the National Traffic and Motor Vehicle Safety Act in 1966, more than 24 million tires have been recalled due to defects. At Nadrich & Cohen, LLP, we have qualified defective tire accident specialists experienced in defending the rights of our clients who have been involved in an accident due to a defective tire.

A Pasco County Circuit Court jury recently returned a $5.6 million verdict against the Goodyear Tire & Rubber Company for selling a defective G159 tire that had originally been designed solely for urban delivery trucks, with a maximum continuous speed rating of only 65 miles per hour, to recreational motor home manufacturers, even though the tire was not suitable for RV use.

Goodyear Proven Aware Of Defective Tire

In 1998 Goodyear increased the speed rating of its G159 tires to 75 miles per hour.  In the trial, evidence was presented showing Goodyear was well aware that the 75 miles per hour rating was improper for safe use with the G159 tire.

The controversial tire, a Goodyear G159, was original equipment on a 2000 American Tradition motor home that crashed on August 11, 2004, seriously injuring the driver and two of his passengers.

The driver, John Schalmo, was traveling westbound on State Road 8 in Chipley when the front passenger side tire of his motor home suffered a tread separation. Schalmo lost control of the RV and veered off the right side of the roadway, heading out of control across the highway into a stand of trees. Schalmo, and his passengers, his wife’s parents William and Ruth McClintock, sustained very serious injuries. William McClintock lost both his legs as a result of the RV accident; he died of causes unrelated to the car accident two years before the case came to trial.
