Kugel Mesh Patch

The second “bellwether” trial in the Kugel hernia patch litigation is set to start later this summer. This trial comes after a Rhode Island jury found the defendants, Davol, Inc. and C.R. Bard, Inc., negligent in the design of the Kugel hernia patch in the first bellwether trial.

Chief Judge Mary M. Lisi, the presiding judge for the Kugel hernia patch multidistrict litigation (MDL), scheduled jury selection to begin July 28 in the second case filed by Christopher and Laura Thorpe, of North Carolina.

The plaintiff allegedly suffered severe internal injuries due to a broken plastic ring on the hernia repair mesh. Thorpe claims that he suffered an abdominal wall abscess and fistula (abnormal connections or passageways between the intestines and other organs) from a broken Kugel hernia patch ring.

The broken ring became coated with bile causing Thorpe to become septic. Thorpe underwent numerous surgeries to repair the damage caused by the defective Kugel hernia patch. The lawsuit claims that he continues to suffer physical pain from the injury.

Hernia Repair Mesh Breaks Under Stress

One of the most prominent flaws in the patch is in the “memory recoil ring” that opens the hernia repair mesh. The hernia repair mesh has been proven to break under the stress of placement in the intra-abdominal space, which is inside the belly area.

More than 1,300 Kugel hernia mesh lawsuits are pending in the U.S. District Court of Rhode Island under Judge Lisi. There are over 1,700 lawsuits of the Kugel patch that have been centralized in Rhode Island Superior Court under Presiding Justice Alice B. Gibney.

Upon its introduction, the Kugel Mesh Hernia Patch was proclaimed to be a new and innovative direction in hernia treatment. By 2005, the Food & Drug Administration (FDA) had received numerous reports of failures associated with the Kugel Patch.

Kugel Hernia Patch Injuries Downplayed By Davol

After investigating the failures of the Kugel hernia patch, the FDA concluded that Davol had downplayed the severity of the injuries being associated with the hernia repair mesh, including the fact that one patient may have died from the product.

The findings alarmed the FDA and they issued their most urgent recall, a Class I recall, of the Kugel Mesh Hernia Patch. The recall was expanded twice by February 2007 and included several various sizes of the patch.

Davol initially blamed the broken mesh rings on the surgeons who installed the Kugel Mesh patch. Davol accused the doctors of making mistakes while implanting the devices which caused the breaks in the rings.

Unfortunately, tests conducted by Davol showed that the failures in the Kugel mesh patch, in almost every case, occurred at the spot where the ring was joined together, this connection was welded by the company.
