NaturaLyte and GranuFlo Blamed for Wrongful Death in New Lawsuit

Two California sisters have filed a lawsuit in the U.S. District Court in Oakland, California, alleging that their mother died as a direct result of negligence and/or fraud on the part of Fresenius Medical Care Holdings, Inc., manufacturer of the now-recalled dialysis products NaturaLyte and GranuFlo. Deborah Lower and Constance Morgan are seeking compensatory and punitive damages for their mother’s death, and for her injuries, pain and suffering.

This isn’t the first lawsuit to be filed against Fresenius, and it certainly won’t be the last. NaturaLyte and GranuFlo have been the subject of intense controversy since the FDA issued its Class 1 recall of the treatments, stating “there is a reasonable probability that use of these products will cause serious adverse health consequences or death.”

It all began with an anonymous source, who leaked a copy of a Fresenius internal memo warning clinicians of increased risk of fatality. The memo revealed – among other things – that the manufacturer knew about the risk and nevertheless continued to market the treatments, while concealing the dangers from the general public. That controversy is now at the center of the Oakland lawsuit.

According to the lawsuit, the treatments contributed to the victim’s death by increasing the concentration of alkaline substances in her blood. GranuFlo and NaturaLyte both contain acetate, which is converted to bicarbonate (an alkaline substance). Other blood dialysis products use lower concentrations of bicarbonate.

Although GranuFlo and Naturalyte were both recalled more than a year ago, there are still a lot of victims out there, including the families of deceased individuals who unknowingly underwent GranuFlo and/or NaturaLyte treatments.
