Naval Retirees Diagnosed With Mesothelioma
More and more retired U.S. Navy personnel are being diagnosed with mesothelioma. 3000 US citizens are diagnosed with the rare form of cancer called mesothelioma each year. Of this group, one third are Veterans of the United States Navy. This deadly disease can take up to thirty years to show up but when it does it can be devastating. Mesothelioma can be caused with even the slightest asbestos exposure. Mesothelioma is a form of cancer that affects the mesothelium, a system of membranes that line the lungs and our other major organs.
This deadly disease has three types. Pleural mesothelioma involves the lungs. Pericardial mesothelioma involves the lining of the heart, and peritoneal mesothelioma involves the lining of the abdominal area. Mesothelioma Causing Asbestos Used Extensively On Navy Ships
U.S. Naval shipbuilders used Asbestos extensively for decades in the construction of Navy ships. Asbestos was the primary insulating material and it was used throughout the entire ship. From the bilges to the upper decks and from the bow to the stern of naval ships, asbestos was present in abundance. There was no area onboard a naval ship built prior to the 1970s that did not contain asbestos in large quantities. Asbestos was utilized below decks in the fire rooms, engine rooms, and boiler rooms.
The mess halls, navigation rooms, and sleeping quarters were inundated with the deadly material. Pipes that run throughout the ships were covered in literally miles of deadly asbestos. Naval personnel and shipyard workers were unavoidably covered in the hazardous material during repair operations. At Nadrich & Cohen, our mesothelioma lawyers are ready to answer all your questions about the deadly disease, call now at 1.800.718.4658.
Navy Knew Of Asbestosis Dangers
The real shame falls on the U.S. government itself because it knew of the deadly effects of asbestos in the 1930s and yet it exposed innocent government employees to the deadly substance and showed an utter disregard for their health and well being. As early as 1939 the Navy’s Surgeon General was fully aware that prolonged exposure to asbestos was causing asbestosis in personnel.
The Navy has been immune from justice in asbestosis/mesothelioma cases, even though an incredible number of veterans have suffered dire health problems and have died from asbestos exposure during their service with the Navy.
The recent ruling by the California appeals court in Plant Insulation Co., v. Superior Court Alameda County et al. A064275 may have changed the immunity the U.S. Navy has enjoyed in past asbestos cases. One of the entities that was allocated 20 per cent of fault in a $10 million jury verdict, Plant Insulation Company, appealed to the state First District Court of Appeals on the exclusion of the Navy from the list of those responsible in the mesothelioma death of Ulysses Collins.

The statement of the court that, “We agree with Plant and conclude the Navy is properly included among those entities to which fault may be apportioned in an asbestos case,” may finally bring justice to naval personnel, both military and civilian.
