A Petaluma nursing home facility is being sued on charges of elder abuse and neglect.

The lawsuit brought against Petaluma Health and Rehabilitation alleges that the facility’s staff engaged in deliberately negligent and reckless behavior by not administering basic nursing care. The lawsuit was filed by Billie Walter, who claims that her 80-year-old mother Elizabeth suffered abuse and neglect during her brief stay at the nursing facility. Specifically, the suit claims that Ms. Walter failed to receive proper nutrition and hydration and that the nursing staff did not provide proper wound care, which lead to an infection that later required hospitalization.

Prior to her stay at Petaluma Health and Rehabilitation, Ms. Walter had been receiving in-home care from Accentcare Home Health of California. While receiving care, she sustained a fall in her home, which necessitated her transfer to the nursing facility. The lawsuit names Accentcare Inc., EHC Management, and Evergreen at Petaluma, LLC as contributing parties to Ms. Walter’s injuries.

In addition to failing to provide adequate food and water as well as medical treatment, the suit alleges that the nursing staff misrepresented the quality of care that Ms. Walter could expect to receive. Billie Walter claims that Petaluma Health and Rehabilitation staff made false claims about the number of health care workers employed by the facility as well as the type of specialized services that were available.

According to the California HealthCare Foundation, the Petaluma facility ranked poorly in terms of staffing, quality of care and living conditions compared to other nursing homes in the state. In 2010, Petaluma Health and Rehabilitation received a total of 15 consumer complaints stemming from allegations of elder abuse and neglect.
