Son of GranuFlo Patient Sues Manufacturer Fresenius
The son of deceased GranuFlo patient is suing Fresenius Medical Care, the popular dialysis service provider. The suit was filed on December 11, 2012, by South Carolina resident Clarence Lee Dubose, Jr. Dubose filed his claim as a representative of the estate of his father, Clarence Lee Dubose. The case was filed in the U.S. District of Massachusetts and Fresenius is accused of breach of warranties, strict liability, and negligence.
According to the claim, the elder Dubose suffered from a fatal heart attack following a dialysis procedure involving GranuFlo and NaturaLyte. This claim mirrors a variety of similar claims that have been made by Fresenius against other plaintiffs in recent months.
According to the claim, the elder Dubose underwent dialysis treatment during a routine appointment on September 19, 2009 at the Fresenius Darlington Dialysis Center in Darlington, South Carolina. The treatment involved both GranuFlo and NaturaLyte. Dubose’s son argues that employees of Fresenius knew of the dangers associated with the dialysis treatments since as far back as 2005. In 2008, some members of the dialysis medical community found that GranuFlo caused dangerously high levels of bicarbonate in the bloodstream. This is precisely what contributed to the demise of Clarence Lee Dubose.
Already, Fresenius Medical Care has paid a reported seven figure amount to settle one such case. This was awarded prior to the recent recall of GranuFlo and NaturaLyte. More cases are expected to be filed in the coming months.
