Plaintiff wins settlement against Starbucks for slip and fall accident.

A jury has ordered Starbucks to pay a California man $7.5 million for a traumatic brain injury he received after a slip and fall accident that occurred in 2008.

According to court records, Anthony Zaccaglin was picking up his order at the Starbucks store located on Melrose in Vista, CA when he slipped and fell, striking his head on the cash register in the process. A store employee had just finished mopping the floor prior to the fall. The store’s manager testified at trial that three safety cones were placed around the area warning customers that the floor was wet but additional witnesses testified that only one was actually present.

The day after the fall, Zaccaglin, a chiropractor, went to a doctor after experiencing severe head pain, nausea, and several other symptoms. He was diagnosed with a concussion initially but was later told that he had suffered moderate brain trauma. Mr. Zaccaglin required a year of intensive brain injury therapy and to date has not been able to return to work.

Mr. Zaccaglin and his family filed suit against Starbucks in 2009 and were initially offered a settlement of $100,000, which they refused. After a two-week court trial, the jury awarded $6,456,230.50 to Zaccaglin and an additional $1 million to his wife for loss of her husband’s companionship, comfort, and care. Zaccaglin’s attorneys have suggested that the settlement could total $8.5 million once legal fees and expenses are factored in.

A spokesperson for Seattle-based Starbucks has expressed disappointment with the verdict. The company says it is currently exploring its options for an appeal.

This case demonstrates how a simple outing can result in a traumatic and life-altering accident.
