One of the most frequent questions new personal injury clients ask us is, “How will this accident affect my insurance rates?”
Over the last 50 years, insurance companies have falsely publicized that when an insured uses their insurance benefits, the insurance company is somehow going to raise rates. This is not the case.
In fact, it is illegal in California for an insurance company to raise an insured’s rates due to an accident, when the insured is not at fault. We explain this to clients all the time, when they are using their insurance benefits, such as medical payments or uninsured motorist’s coverage. This mostly occurs with Uninsured/Underinsured Motorist coverage (which our client has paid for) when the at-fault driver either does not have insurance or does not have enough insurance.
The California Insurance Code states that imposing or requesting an additional premium for a motor vehicle policy, or refusing to renew such a policy, because the insured was involved in a motor vehicle accident, is illegal unless the insured was at fault, or substantially at fault in the accident.
