A single plaintiff is seeking to have the Wright Conserve litigation consolidated for pretrial proceedings.

One of the plaintiffs in the Wright Conserve hip implant litigation is seeking to have a number of the cases consolidated in a Georgia court.

According to reports, plaintiff Danny James has asked the U.S. Judicial Panel on Multidistrict Litigation to consolidate the hip implant lawsuits in either the Northern or Southern District Court for pretrial proceedings. Mr. James argues that consolidating the cases will help to streamline the judicial process and reduce costs for both the plaintiffs and the defendant, Wright Medical Technology, Inc.

The current litigation concerns the company’s Plus Total Resurfacing Hip System. A handful of lawsuits have been filed against the medical device manufacturer, alleging that the metal-on-metal hip implants caused serious complications, including severe pain, tissue damage and metallosis, which occurs when small bits of metal are shed into the body. The Wright Conserve hip implant lawsuits mirror those filed against Johnson & Johnson subsidiary DePuy Orthopedics. Litigants in those cases allege serious injuries stemming from the company’s ASR and Pinnacle hip replacement systems.

The Wright Conserve hip implant was first approved by the Food and Drug Administration in 2009 under the organization’s 510(k) system. The 510(k) guidelines allow the approval process to be streamlined if a manufacturer can demonstrate that their product is substantially similar to one already on the market. In his petition, Mr. James also claims that the FDA has received at least 200 complaints about the Wright Conserve hip implant systems. It is expected that more plaintiffs will follow suit in filing claims for damages.
