Plaintiff Karen Hoggarth filed a lawsuit in July 2010 alleging that the Zimmer hip is defective and has an unacceptably high failure rate.

Zimmer Durom Cup Failure Rate Unacceptable

According to the Hoggarth lawsuit, the failure rate of the Zimmer Durom cup is between 20 percent and 30 percent. The true failure rate could reportedly increase as more of the devices fail over time.

Hoggarth received her implant in 2008, four months later Zimmer issued a “temporary suspension” of the medical device. Hoggarth must now undergo a painful and invasive revision surgery to replace the failed medical device.

Defective Zimmer Durom Cup Destroying Lives

“Now, my life is so limited due to the pain that the defective Durom cup implant has caused me.” Hoggarth said that even walking upstairs is extremely painful.

According to her lawsuit, Karen Hoggarth v. Zimmer Holdings, Inc. and Zimmer, Inc., Zimmer was receiving complaints from physicians about the defective Zimmer Durom cup but Zimmer officials reportedly blamed the problem on the implanting surgeons.

In 2008 Zimmer allegedly suspended sales of the cup to update labeling. No recall of the Durom cup has been announced.

Meanwhile, Senator Charles E. Grassley (R-Iowa), a senior member of the Senate Finance Committee, sent a letter to Zimmer Holdings requesting that the company disclose information about its methods of handling customer complaints about its devices as well as details on how it tracks the long term performance of its medical devices.

According to an article in the New York Times on 6/30/10, the senator became aware of disputes between Zimmer and two medical consultants after the Times published an earlier article on 6/20/10.

Over 12,000 patients in the U.S. have the artificial hip component implanted from doctors who were not provided proper instructions or training prior to implanting the device.
