Pfizer Fails in Effort to Combine Zoloft Class Action Lawsuit with MDL

The clerk of the U.S. Judicial Panel on Multidistrict Litigation has rejected a request by Pfizer to combine the company’s existing multidistrict litigation with a new consumer class action lawsuit. The litigation surrounds Zoloft, a popular antidepressant which has been at the center of tremendous controversy not only due to questions regarding its efficacy, but also concerns about severe birth defect risks.
The multidistrict litigation is currently being tried in the U.S. District Court for the Eastern District of Pennsylvania, and accuses of Pfizer of marketing Zoloft without adequately warning consumers about the potential for serious birth defects. The MDL currently includes around 250 cases, brought forth by mothers who claim that the drug caused congenital birth defects such as holes in the heart, neural tube defects and other deformities.
The consumer class action lawsuit was filed in Northern California by plaintiff Laura Plumlee, who alleges that three years of taking Zoloft did absolutely nothing to combat her depression symptoms. The lawsuit makes the claim that Zoloft is no better than placebo, and Plumlee’s legal team cites comprehensive studies to make their case.
It appears that the class action suit and multidistrict litigation will remain on opposite sides of the nation. Though this is speculation, it seems highly possible that Pfizer wishes to use the class action lawsuit to its advantage. If the drug maker can draw attention to accusations of poor efficacy, this might raise questions about Zoloft’s ability to cause birth defects. Of course, a drug can cause dangerous side effects without achieving its intended purpose. The two points are not mutually exclusive, and therefore, each should be examined on its own merits.
